Their findings indicated that more and more states are factoring in cigarette smoking when making final decisions regarding the custody of minor children. Parents who are considered to be smokers are less likely to be granted full custody of a child due to their addictive habit.
The data also shows that judges are administering orders that prohibit cigarette smoking around children, in cars when children are present, and inside of residential homes. The smoking habits of family members that will be near the children are also considered before a custody arrangement is determined.
