Pet custody cases have gained popularity across the United States. In cases where couples do not have biological children, their pets may act as their kids. When these couples divorce, the custody of their cats and dogs becomes very relevant.
A 2006 survey of lawyers and attorneys revealed a 25 percent increase in pet custody cases from 2001. Another study will be conducted soon, but attorneys believe that this number has only gone up. Same-sex marriages and civil unions are a large factor in the increase in these cases.
In cases where children and pets are involved, the judge will usually rule that the pet goes with the child. But, in cases where the pet is the child, the guidelines aren’t as simple. There are no current laws about visitation rights for animals in break-ups, and therefore these decisions can be agonizing and heart-wrenching.
